Religious Organization Rules and Regulations

IRC Section 501(c)(3) - (Internal Revenue Code)

This document outlines the stipulations necessary to qualify for federal income tax exemption and take tax-deductible money from your......followers or anyone else who wants to give you money.

It says to start a church or other religious organization and get all the perks that go with it, the church or religious organization must:

1) operate only for religious or charitable purposes.
2) make sure the net earnings don't benefit a private individual or shareholder.
3) not try and influence legislation....too much.
4) not intervene in political campaigns.
5) not do anything illegal or violate fundamental public policy.

IRS Tax Guide for Churches and Religious Organizations

To be a religious organization under section 501(d) you do NOT have to submit an application form. You DO need to file form 1065 each year. You can NOT take tax deductible contributions UNLESS the "charitable fund" meets 501(3) and 508(a).

 

If you are a non profit organization under IRS Section 501(d)(Religious Organization) you must make it known that donations to your organization are not tax deductible for those who donate. That is, unless you are eligible to take tax deductible money...outlined by Section 170(c).

 

Section 170(c) decides if cash or land given to an organization is a gift or a contribution to your cause.

United States Government's Definition of a Charitable Contribution:

For purposes of this section, the term “charitable contribution” means a contribution or gift to or for the use of — 2) A corporation, trust, or community chest, fund, or foundation — (B) organized and operated exclusively for religious, charitable, scientific, literary, or educational purposes, or to foster national or international amateur sports competition (but only if no part of its activities involve the provision of athletic facilities or equipment), or for the prevention of cruelty to children or animals;

And....charitable contributions are allowed as deductions....if verified under regulations set by the Secretary....which pretty much gives the U.S. Government the power to decide on the spot if the money given to you is tax deductible or not.

Who Must File a Tax Return to The IRS Each Year?

Every organization exempt from federal income tax under section 501(a) must file an annual information return except:

1. A church, an interchurch organization of local units of a church, a convention or association of churches, or an integrated auxiliary of a church.
